A litigant's public opinion leverage can be a potent dynamic in winning or resolving a legal matter.
After winning a record verdict in a U.S. court, an international business concern with interests in Australia and abroad sought to intensify settlement pressure on a European defendant.
As the case moved through post-judgment appeals (and the Australian concern's legal position strengthened with each ruling), a series of news reports appeared in European financial pages. The reports examined evidence introduced in the trial and analyzed, among other things, rumored threats to bankrupt subsidiaries of the European defendant to avoid paying the judgment.
In subsequent negotiations in London, the European company's CEO indirectly confirmed the effect of the news coverage by repeatedly expressing his indifference to persistent news coverage of the dispute.
A nine-figure settlement soon was announced, just as the European company sought market support for a restructuring proposal. Counsel for the Australian concern soon resolved the case, convinced that the targeted news coverage that they and their client discreetly developed had helped prevent another round of costly litigation.
