When an online entrepreneur accused of selling bootleg and marked-up items with inferred ties to a prominent recording artist set up shop in Texas, a Houston law firm responded quickly.
The law firm immediately filed suit in Texas federal court. Powers MediaWorks LLC was retained by the law firm to help ensure fair and accurate news coverage of the litigation. The recording artist wanted the defendant to be seen as a serial trademark infringer and not as a victim or a "David" fighting "Goliath."
After a contentious hearing before the court over the recording artist’s request for a temporary restraining order, the defendant ignored a court order to shut down the website until the litigation was resolved. He soon was held in contempt of court and ordered to jail.
Time in jail convinced the defendant, who was accused of operating related online enterprises in other jurisdictions, to settle case by agreeing to a permanent injunction stating that he and anyone working for or with him “be prohibited in perpetuity from purchasing or possessing products” with the artist’s likeness or any registered slogans or images. The lawsuit and settlement were accurately reported throughout the world.
